Do I need a permit to replace windows in Clearwater?

Yes. Section 105.1 of the Florida Building Code requires a permit to alter a building, and swapping a window or exterior door alters the envelope. Like-for-like does not exempt it. In Clearwater the application goes through the Construction Services Division inside Planning and Development, and it carries a Florida Product Approval number for each unit. The 8th Edition of the code, effective December 31, 2023, is what your reviewer is holding today.

My association says it controls my windows. Is that true?

Often, yes. Section 718.113(1) of the Florida Statutes puts common element maintenance on the association except where the declaration assigns a limited common element to the owner. Separately, Section 718.113(5) requires your board to adopt hurricane protection specifications for each building, and those specifications may set color, style and other factors the board thinks matter. Read the declaration article and the adopted spec before you shop anything.

Why does a reserve study list windows and exterior doors?

Because the statute names them. Section 718.112(2)(g) requires a structural integrity reserve study every ten years for each building three habitable stories or higher, and windows and exterior doors are one of the enumerated components alongside roof, structure, plumbing and electrical. For budgets adopted after December 31, 2024 an owner-controlled association generally cannot fund those items at zero. That is why your building has a date.

Is a glass and glazing contractor state licensed in Florida?

No, and anyone telling you otherwise is selling something. Senate Bill 704 in the 2012 session removed glass and glazing from the mandatory license types under Chapter 489, so the state certification is voluntary. Local jurisdictions may still require licensure, and Pinellas County has since 1973 through its Construction Licensing Board, which covers every municipality in the county including Clearwater.
